According to the Canadian case Law, the Purchaser is entitled to obtain the house and property on the closing date in the same condition as it was on the day the Agreement of Purchase and Sale was signed. Problems arise on the date of closing when windows are broken after the contract is signed or there is damage to the property. If your house is going to be vacant prior to the closing, please have a neighbor keep an eye on the house so that broken windows etc. will be repaired. Another common complaint which causes problems at the time of closing is damage to the interior of the house caused by the movers when moving out of the property. Door frames are broken, carpets torn, walls gouged. To avoid having the Purchaser complain at the time of closing, would you please ensure that all damage is repaired or that proper compensation arrangements are made.
